Lady Gaga Loses LadyGaga.org Fight

Lady Gaga has lost a challenge over LadyGaga.org.

Last month, Mother Monster (real name: Stefani Germanotta) filed a complaint with the National Arbitration Forum over the website, which she claimed had been registered in violation of her trademark.

According to Germanottas camp, the site was intentionally registered to capitalize on Lady Gagas fame and was disrupting Lady Gagas ability to promote herself and her endeavors.

T he fan who operates the site disagreed, saying it was a non-comercial venture that supports the performer and gives her free publicity. She argues that LadyGaga.org, which was registered in June 2008, does not have any sponsored links or links to third-party websites which market and sell merchandise bearing Gagas name, and therefore represents fair use.

Arbitrators agreed, ruling that Germanotta failed to demonstrate that the fan had registered the site in bad faith or without rights or legitimate interests in respect of the domain name.

[Lady Gaga] cannot have fame without fans and fans cannot have fan sites without referring to the objects of their adoration, concluded the panel.

And so LadyGaga.org is allowed to continue under present ownership.
